Appeals Version - Proposed District Plan
The Proposed District Plan - Decisions Version was publicly notified on 19 June 2025.
Council has updated the provisions of the Proposed District Plan (PDP) that are subject to appeal. Provisions of the PDP that are under appeal will be shown in red text text with the appeal reference as a footnote to the right-hand side of the provision in what will then be known as the Proposed District Plan – Appeals Version.
The provisions and features shown in the Proposed District Plan – Appeals Version as being subject to appeal will be based on the appeals filed with the Environment Court and Council’s understanding of the grounds of the appeal and the potential relief sought by the appellant. While Council has endeavored to identify all provisions of the PDP that are subject to appeal and will revise the annotations as appeals are resolved, it is up to users of the District Plan to review the relevant notice of appeal to determine whether the rules are operative.
The parts of the PDP that are under appeal will change over time as appeals are settled by mediation, determined by the Environment Court, or withdrawn. This means that the Proposed District Plan - Appeals Version will be a ‘living’ document and it will change to reflect the progress of the appeals. Proposed District Plan rules which are not subject to appeal are treated as operative under section 86F of the Resource Management Act 1991; equivalent rules in the 2009 Operative District Plan have ceased to apply.
Proposed District Plan rules which are subject to appeal have legal effect but cannot be treated as operative until the appeal is settled, determined or withdrawn. Until that time, equivalent rules in the 2009 Operative District Plan continue to apply.
Where Proposed District Plan provisions (including planning maps) are marked as being subject to an appeal in the Proposed District Plan – Appeals Version, the 2009 Operative Waitomo District Plan will also need to be checked to see if resource consents must be applied for under that Plan as well.
