Waitomo District Council Provisional Local Alcohol Policy - Notice of appeal process

26 Jul 2022, 2:26 PM

In accordance with Section 80 of the Sale and Supply of Alcohol Act (the Act), the Waitomo District Council hereby gives public notice that a Provisional Local Alcohol Policy (PLAP) was adopted on 26 July 2022, and is now open for appeals. An appeal can only be made to the Alcohol Regulatory and Licensing Authority (ARLA) within 30 days of public notification.

Only persons or organisations who submitted on the draft Local Alcohol Policy can appeal against an element of the PLAP (except for the Police and the Medical Officer of Health who can appeal regardless). The only ground on which an element of the PLAP can be appealed against is that it is unreasonable in the light of the object of the Sale and Supply of Alcohol Act 2012.

An appeal made under Section 81 of the Act must be made in accordance with Section 18 of the Sale and Supply of Alcohol Regulations 2013.

The PLAP is available to view here. (PDF 331 KB)
